Palm Desert police conducted a battery investigation at the scene at about 1 a.m. on Dec. 12. “The victim desired prosecution,” says Sgt. Sept. 24: Lindsay Lohan arrives at a court hearing in Los Angeles after failing a court-mandated drug test. Lindsay Lohan ‘s clean streak may have met its end. “The incident is being investigated as a misdemeanor.” A source close to Lohan, 24, says the actress denies pushing the woman first.

Police arrived at a Betty Ford Center facility early Dec. 12 in response to incident involving Lohan, the Riverside County Sheriff’s Department said in a statement to ABCNews.com. Riverside County sheriff’s Deputy Herlinda Valenzuela said officers responded to a call on Dec. 12 shortly after 1 a.m. for an incident involving Lohan. It all comes back to Lindsay’s Beverly Hills DUI arrest in 2007 a crime for which she’s still on probation and the probation doesn’t terminate until August 2011. It isn’t known whether she had been drinking; the Betty Ford Center regularly tests patients for alcohol and drugs.

No arrests were made, but an investigation is ongoing. TMZ is reporting that Lindsay says a staffer put her hands on Lindsay after the star arrived about 10 minutes late for curfew. As we previously reported, the BFC staffer wants Lindsay prosecuted for criminal battery. Lohan was reported as a suspect in the investigation. A judge overseeing her probation for a 3-year-old drunk driving case has required Lohan to remain at the rehab center until Jan. 3. PHOTOS: How Lindsay’s face has changed The alleged incident is a misdemeanor, added the spokesperson, and the investigation is “ongoing.” Per court order, Lohan was scheduled to leave the rehab Jan. 3 but L.A. The staffer wants Lohan prosecuted for criminal battery. The actress could spend up to six months in jail if convicted, TMZ has learned. “Therefore, no one was arrested at the scene. Fox warned he’d send Lohan to jail for up to six months if she got into trouble.

One of the terms of the probation is “obey all laws” and if Judge Elden Fox decides LiLo committed a battery at the BFC, he could send her back to the slammer for 180 days. The investigation is currently ongoing. Earlier this year, she served two prison stints for violating her 2007 DUI probation. One of the terms of Lohan’s probation is to abide by all laws. A violation could send her back to jail. As of Tuesday, Beverly Hills Superior Court Judge Elden Fox, who’s overseeing her case, has not been notified, according to a court source.
